ONY - GROUPE SHF


Introduction:

These general terms and conditions of sale are intended to define the contractual relationship between the company Groupe SHF, the customer, and the conditions applicable to any purchase made through the shop. The acquisition of a product through the shop implies unreserved acceptance by the customer of these general terms and conditions of sale, which the customer acknowledges having read prior to placing their order. Before any transaction, the customer declares that they have full legal capacity, enabling them to be bound by these general terms and conditions of sale.

The company Groupe SHF reserves the right to modify these general terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its website. As a result, the applicable conditions will be those in force at the date of the customer's order.

This e-commerce website is published by SARL Groupe SHF, registered with the Paris Trade and Companies Register under number 919 285 973, with a share capital of €1,000, and whose registered office is located at 16 rue Cuvier 69006 Lyon. Intra-community VAT number: FR 06919285973

Article 1. Definitions

Shop: the website: https://www.my-ony.com/
Customer: the individual who, acting in a professional or commercial capacity, enters into an agreement with the company Groupe SHF.
Agreement: any contract or agreement between Groupe SHF and the Customer, of which these general terms and conditions of sale form an integral part.
Products: all intimate products sold by Groupe SHF, including sex toys and consumables.
After-sales service: customer support service.
Marketplace: a platform connecting professionals and buyers (Amazon, CDiscount, eBay, Rakuten, …)


Article 2. Products

2.1 Stock
The products offered are those listed on the Groupe SHF shop, subject to available stock. Groupe SHF reserves the right to modify the product range at any time and to remove items from its shop catalogue.

2.2 Technical specifications
Groupe SHF presents on its shop the products for sale with the necessary characteristics to comply with Article L 111-1 of the French Consumer Code, which provides potential customers with the ability to know, before placing a definitive order, the essential characteristics of the products they wish to purchase.

Photographs are as accurate as possible but are not binding on Groupe SHF. The sale of products presented on the shop is intended for all potential customers residing in countries that fully authorise the entry of these products onto their territory.
All prices and other information appearing on the shop are subject to obvious programming, typing, spelling or translation errors.

2.3 Reviews
Reviews from internet users or customers are subject to validation and are not published on the shop in real time.
Groupe SHF reserves the right to remove comments in response to the publication of abusive or defamatory content by internet users or customers.

2.4 Product
The ingredients and materials of each product are visible on the shop. In the event of a known allergy to one of the ingredients and/or materials listed on the Shop, the Customer must not use the product and should contact Customer Services to exercise their right of withdrawal or to benefit from the "satisfaction or money back" offer.


Article 3. Pricing and Payment Methods


3.1 Pricing
The prices displayed in the shop are in Euros (€) inclusive of all taxes (VAT included) based on the VAT rate applicable on the date of the order. Any change in the VAT rate may be reflected in product prices. Groupe SHF reserves the right to modify its prices at any time, it being understood that the price shown in the shop on the date of the order will be the only price applicable to the customer. The prices shown do not include delivery costs, which are charged in addition to the price of the products purchased depending on the total order amount.

3.2 Order and Payment Methods
Groupe SHF is free to choose which payment methods to offer, and these may also change at any time.
Secure payment methods available in the shop: Paypal, Scalapay, Apple Pay and Credit/Debit Card.

3.3 Promotional Code
Groupe SHF reserves the right to cancel any sale involving a promotional code deemed invalid by the shop, even if the order has already been placed.


Article 4. Right of Withdrawal


Under European Directive 2011/83/EU, the customer has fourteen calendar days from the delivery of their order to exercise their right of withdrawal and return the product to Groupe SHF for a refund without penalty, with the exception of return shipping costs, which remain the customer's responsibility.

In accordance with Article 16(e) of European Directive 2011/83/EU, sealed goods that cannot be returned for reasons of health protection or hygiene (Sensitive Goods) cannot be subject to a right of withdrawal if their packaging has been opened or unsealed by the customer after delivery.
Therefore, given the nature of our products and for obvious hygiene reasons, products from the store cannot be returned on the grounds of withdrawal if their packaging has been unsealed (VOID security labels or plastic film removed).

Otherwise, if the product has not been unsealed, the buyer must contact customer services to submit their right of withdrawal via our dedicated customer support page.
A full refund of the order, excluding delivery costs, will be processed automatically 30 days after receipt of the complete order.
The right of withdrawal applies only within European Union countries.

- In the event of a withdrawal request for one or more individual product(s) from a discounted order, the refund amount will correspond to the following value:

Refund amount = Total order amount (excluding shipping costs) - Amount of the product(s) kept without discount.


Article 5. Satisfaction Guarantee


Options after opening the packaging:

1. To have:

  • If the product packaging has been unsealed (VOID security labels or plastic film removed), you may still benefit from the "satisfaction guaranteed or your money back" offer.
  • You have 30 calendar days from delivery to request a credit note.
  • This store credit, equivalent to the price of the product concerned, is valid on all products in our shop (excluding delivery costs and additional promotions).
  • This is an opportunity for you to explore other products from our range.

2. Refund:

  • If you are still not satisfied after using your credit note and do not wish to order any other products, a refund equivalent to the price of the product concerned will be issued (excluding delivery costs).
  • The refund will be processed via the original payment method.

For your information, European legislation, under Article 16(e) of Directive 2011/83/EU, states that: "the right of withdrawal may not be exercised for goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection."
ONY is the only brand to offer a satisfaction guarantee or money-back offer on its intimate accessories.
Because your satisfaction is our priority.

The date from which your 30-day period begins is the delivery date shown on the tracking link for the product(s) purchased.

To benefit from the "Satisfaction Guaranteed or Money Back" offer, the customer must submit their request via our dedicated customer support page within 30 calendar days, specifying the product concerned, your name and order number. Once your request has been confirmed by our customer service team, the accessories must be returned to the following postal address:

Upon receipt of the product(s) concerned, a credit note will be sent to the customer electronically.
The credit note is valid for 90 calendar days and can only be used on a single order.

The refund will be processed within approximately 30 days of receiving the return, via the payment method you used to place your order.

The "Satisfaction Guaranteed or Money Back" offer is valid once per customer.


Article 6. Warranty


All exchange requests must be submitted via our dedicated customer support page.

6.1 Commercial Warranty

Groupe SHF guarantees the customer's product for 2 years from the date of purchase against any material or manufacturing defect that affects the proper functioning of the product. It does not cover aesthetic deterioration caused by normal wear and tear, nor damage resulting from misuse, accident or lack of maintenance. Any dismantling or opening of the product (or its accessories) will void the warranty.

The warranty does not cover any cosmetic deterioration related to an accident, improper maintenance or negligence.
The use of oils & sun creams, lip care products and lip balm sticks, essential oils, coconut oil and food oils of any kind may cause damage to silicone-based products. Please do not use any of the products mentioned above with intimate products purchased from the store. Failure to comply may result in the warranty conditions no longer applying.

To make a warranty claim, the customer must submit a request via our dedicated customer support page providing the purchase invoice for the product in question. It is therefore essential to retain the purchase invoice.

In the event of a product warranty return, Groupe SHF will proceed with an exchange or issue a "credit note" to the customer if the product is no longer available for sale in the store.
The value of this "credit note" will be equivalent to the customer's purchase price excluding delivery charges.

6.2 Legal Guarantee of Conformity

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, as provided for by Articles 1641 and following of the French Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.

If the delivered product does not comply with the agreement, the customer must inform Groupe SHF within 7 days of discovering the defect by email at "contact@my-ony.com".

Once the customer takes physical possession of the ordered products, the risks of loss or damage to the products are transferred to them.
Groupe SHF is released from all liability towards the customer if they have used a delivered product in a manner other than that recommended, prescribed or for which it was intended.


Article 7. Product returns


For any product return request from the customer, including: a "Right of Withdrawal", "Satisfaction Guaranteed or Refunded" or "Warranty" request, the customer must first contact our customer service team by sending an email via our dedicated customer support page.
If the need to return the product is confirmed by the customer service team, the customer must send back, at their own expense, the product(s) by post to the following address:

Article 8. Order


8.1 Product availability

In the event that an ordered product is unavailable, particularly due to Groupe SHF's suppliers or stock update issues, the customer will be informed as soon as possible and will have the option to cancel their order.
The customer will then have the choice of requesting either a refund of the amounts paid within 30 days at the latest from the date of payment, or an exchange in the form of a credit note.
The store is not intended to sell its products in large quantities. Accordingly, Groupe SHF reserves the right to refuse large orders.

8.2 Order cancellation

Groupe SHF reserves the right not to process a payment and not to confirm an order for any reason whatsoever, and in particular in the event of a supply issue or any difficulty relating to the order received.

8.3 Marketplace

Groupe SHF's general terms and conditions of sale apply solely to the store and not to the sale of the brand's products on marketplaces (Amazon, Cdiscount, eBay, Etsy, Joom, Rakuten, etc.).
Likewise, the general terms and conditions of sale of the marketplaces apply solely to orders placed on those platforms.


Article 9. Delivery


Products are delivered to the address provided by the customer on the order form.

The customer may choose to be delivered to their home address or to a collection point, with delivery in either 3 working days or 24 hours.
Groupe SHF works primarily with La Poste services (Colissimo, Chronopost 24h) as well as Mondial Relay.

Groupe SHF commits to dispatching every order within a maximum of 24 working hours for any order placed before 11am, starting from the day following the customer's order.*
Should this 24-hour dispatch deadline not be met, and the customer has paid for a 24h delivery option, the customer may request a refund of the delivery costs.

Groupe SHF provides the customer with their parcel tracking number by email as soon as the order is being prepared. The day the tracking email is received does not count as the dispatch date.

Groupe SHF is not responsible for the loss or theft of products occurring during delivery, nor for any packaging damage sustained during transit that may result in reduced discretion regarding the origin of the products contained in the parcel.
Any complaint must be filed by the customer with the carrier within one week. The customer must also notify Groupe SHF by email regarding this complaint to the carrier.

Before each order is dispatched, Groupe SHF photographs the ordered items in their shipping box, clearly showing the shipping label.

Should the customer place several orders on the same day using the same delivery method, Groupe SHF may dispatch the orders in a single parcel.
Any delivery costs relating to the unperformed delivery will be automatically refunded to the customer.

Shipping costs vary depending on the destination country and the selected carrier.
One delivery method for mainland France is free of charge from €79 of purchases.

* The Groupe SHF logistics team will do everything possible to meet these dispatch deadlines. These deadlines may be exceeded during certain periods (Christmas or sales periods, for example). In the event of a dispatch delay, the customer will be notified automatically by email.
If the dispatch delay exceeds thirty days from the date of the order, the sales contract may be cancelled and the customer refunded.

Article 11. Intellectual Property


The "ONY" brand, logos, slogans, designs, instructions, photos and blog articles featured on the shop are the property of the publisher and are protected by intellectual property law, and more specifically copyright law, on behalf of the company Groupe SHF.
Any total or partial use of the website or its content, by any means or on any medium, for commercial or advertising purposes, is strictly prohibited and shall engage the liability of the user.


Article 12. Liability

 

Groupe SHF, in the distance selling process, is bound only by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the internet network, such as data loss, intrusion, viruses, service interruption, or other unintentional issues. These general terms and conditions of sale are governed by French law. In the event of a dispute, French courts shall have sole jurisdiction.
Some products on this site are of an adult sexual nature. Proof of identity may be required upon delivery to confirm that the purchaser is 18 years of age. If they are unable to provide such proof, the goods will not be delivered.
The products sold on the shop must be used between consenting adults, in accordance with the specified intended use and with respect for human anatomy and the human body.
They must be kept out of reach of minors. So-called "edible" products must not be consumed as food or ingested in large quantities. Groupe SHF shall under no circumstances be held liable in the event of a customer's allergic reaction to any of the products available on the Shop.


Article 13. Dispute Resolution


The validity of all general terms and conditions of sale is not affected if any provision of these general terms and conditions of sale proves to be invalid. In such a case, the parties shall adopt one or more new provision(s) with the aim of replacing the original provision.
The intent of the new provision shall align as closely as possible with the legal purpose of the original provision.

In the event of a dispute, Groupe SHF and the customer will endeavour to resolve the matter amicably.

Pursuant to Article 14, paragraph 1 of European Regulation No. 524/2013 of 21 May 2013 relating to ODR, the European Commission makes available to consumers an online dispute resolution platform accessible at: https://ec.europa.eu/odr/.

These general terms and conditions of sale are governed by French law. For any dispute or legal proceedings, the competent court shall be that of Paris, France.

Article 14. Customer Account


In order to create a customer account, the customer must provide the following information:

  • Title;
  • First name;
  • Date of birth;
  • Last name;
  • Postal and billing address;
  • Email address;
  • Phone number.

The customer must choose a sufficiently secure personal password and ensure it is kept confidential. It is the customer's responsibility not to disclose their username and password.
After creating a customer account, the customer benefits from a secure connection when accessing the website. The customer account remains active for a period of 7 years from the date of the last order placed.
After this period, it may be deactivated and the customer will need to create a new customer account before being able to place new orders or use the instant checkout.
